End User License Agreement (EULA)
1. Introduction
This End User License Agreement (“EULA”) is a legal agreement between you (the ‘Player’) and Hi'iaka Studio (“the Studio”) regarding the use of the video game developed by the Studio, including its updates, patches, and related content (“the Game”).
By installing, accessing, or using the Game, you agree to the terms of this agreement. If you do not agree to these terms, you must not install or use the Game.
2. System Requirements
To function properly, the Game requires a compatible operating system. The minimum and recommended specifications are available on the Studio's official website or on the Game's distribution platform. The Studio does not guarantee that the Game will function properly on unsupported or modified systems. We recommend the following minimum configuration to enjoy the Game:
- Intel Core i5-4590;
- NVIDIA RTX 2060;
- 8GB RAM;
- Windows 10;
- An internet connection to download Game updates.
3. License Grant
The Studio grants you a limited, non-exclusive, non-transferable, and revocable license to:
• Install and use the Game for personal, non-commercial purposes.
• Receive and use updates or patches provided by the Studio.
This license does not grant you any ownership rights in the Game.
4. Restrictions
You agree not to:
• Copy, modify, distribute, or create derivative works based on the Game.
• Disassemble, decompile, or attempt to access the source code.
• Use the Game for commercial purposes or in connection with illegal activities.
• Exploit vulnerabilities or use third-party software to modify the gaming experience.
• Harass, threaten, or harm other players via the Game's online features.
5. Intellectual Property
All intellectual property rights related to the Game, including graphics, sounds, text, and code, belong to the Studio. You may only use these elements within the scope of the license granted.
6. Updates
The Studio may provide updates, patches, or modifications to the Game. Some updates may be mandatory in order to continue using the Game. The Studio reserves the right to modify or remove certain features without prior notice.
7. Changes to the EULA and Privacy Policy
The Studio may modify this EULA and its privacy policy at any time. Changes will be posted on the official website or in the Game. By continuing to use the Game after such changes, you agree to the new terms.
8. Termination, Suspension, and Restrictions on Use
The Studio may suspend or terminate your access to the Game at any time, including in the event of a violation of the terms of the EULA or harmful behavior towards the community. In the event of termination, you must cease all use of the Game and uninstall it. The Studio may also limit certain features or restrict access to online services.
9. International Use
The Game is intended for worldwide use, but certain features may be limited or unavailable depending on your country of residence. You are responsible for complying with local laws applicable to your use of the Game.
10. Feedback and Suggestions
Any suggestions, ideas, or feedback you provide to the Studio regarding the Game may be freely used by the Studio without any obligation to compensate you. You waive any intellectual property rights you may have in such contributions.
11. Data Protection
The Studio respects the privacy of players. The data collected is processed in accordance with the Studio's privacy policy. This may include technical data, usage statistics, and information related to your account. You can view, modify, or delete certain data via the Game settings or by contacting the Studio.
12. Limitation of Liability
The Studio shall not be held liable for any indirect damage, loss of data, or service interruptions related to the use of the Game. The Game is provided “as is,” without any warranty of fitness for a particular purpose.
13. Applicable Law
This contract is governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the competent courts within the jurisdiction of the Studio's registered office.
